ENCORE CAR WASH — TERMS OF USE

These Terms of Use ("Terms") are a binding agreement between you ("Customer," "you," or "your") and Encore CW, LLC, a Delaware limited liability company, together with its subsidiaries and affiliates (collectively, "Encore," "we," "us," or "our"). These Terms govern your access to and use of Encore's car wash locations in Illinois and Indiana, our website, and any mobile application (collectively, the "Services").
BY PURCHASING A MEMBERSHIP, USING OUR WEBSITE OR APP, OR VISITING AN ENCORE CAR WASH LOCATION, YOU ACKNOWLEDGE THAT YOU HAVE READ AND UNDERSTOOD THESE TERMS AND AGREE TO BE BOUND BY THEM. IF YOU DO NOT AGREE, DO NOT USE THE SERVICES.
THESE TERMS INCLUDE AN ARBITRATION AGREEMENT AND CLASS ACTION WAIVER IN SECTION 12, WHICH AFFECT HOW DISPUTES BETWEEN YOU AND ENCORE ARE RESOLVED. PLEASE READ THAT SECTION CAREFULLY.
Eligibility – You must be at least 18 years of age to create an account or purchase a Wash Club Membership. By using the Services, you represent that you meet this requirement and that all information you provide to Encore is accurate and truthful.
Personal Use Only. Wash Club Memberships and the Fast Pass are for personal, non-commercial use only. Vehicles used for ridesharing (including Uber, Lyft, or similar platforms), delivery services, taxi service, or other professional driving purposes are not eligible for enrollment. Encore reserves the right to suspend or terminate any Membership or Fast Pass enrollment found to be used for commercial purposes, without refund.
Communications; Text and Email Consent – By providing your phone number and/or email address to Encore whether at enrollment, in person, online, or otherwise, you authorize Encore to contact you by text message (SMS/MMS) and email regarding your account, Membership or Fast Pass enrollment, transactions, billing, and promotional offers. Message and data rates may apply.
Encore will never sell or share your contact information with third parties for their own marketing purposes. Your contact information may be shared only with service providers who help Encore operate the Services (such as payment processors or messaging platforms), and only for that purpose.
You may opt out of promotional text messages at any time by replying STOP to any text, and out of promotional emails by using the unsubscribe link in the email or by contacting us at info@encorecarwash.com. Opting out of promotional messages does not opt you out of transactional messages needed to service your account, such as billing or cancellation confirmations.
Wash Club Membership Plans
The Encore - Includes Graphene Shield, Carnauba Wax, Seal N' Shine, Wheel Polish, and UV Protect, plus full access to the services included in The Royale and The Lil' Darlin.
The Royale - Includes Lava Bath, Vision Clear, Bravo Blast, and Tire Shine, plus full access to the services included in The Lil' Darlin.
The Lil' Darlin - Includes Chassis Wash, Bumper Blast, Rim Blast, Heated Dry, and free vacuum access.
Single-visit washes are also available at applicable posted pricing, including The Dealeo (light wash with free vacuum access), for customers who prefer not to enroll in a Membership. Encore reserves the right to modify Membership pricing, wash packages, included features, operating hours, or program rules at any time, with notice as required by applicable law. Current pricing and package details are available at any Encore location or at encorecarwash.com. "Unlimited" access under any Membership is defined as one (1) wash per vehicle, per day.
4. The Fast Pass Program – For customers who are not ready to commit to an Unlimited Wash Club Membership, Encore offers The Fast Pass, a pay-per-visit convenience program.
Encore offers the following recurring monthly membership plans (each a "Membership"), available at participating Illinois and Indiana locations:
4.1 How It Works. When you enroll in The Fast Pass, Encore keeps your selected wash package and a payment method of your choice on file, linked to your vehicle's license plate. On each visit, our system automatically recognizes your license plate, confirms your selected wash, and charges the payment method on file - applying a 10% discount to that wash. The gate opens and you drive through, with access to our reserved member lane.
4.2 No Subscription Commitment. Unlike a Wash Club Membership, The Fast Pass does not involve a recurring monthly subscription fee. You are only charged, at the discounted rate, when you actually visit for a wash. There is no minimum number of visits and no auto-renewing monthly charge under this program.
4.3 Enrollment. The Fast Pass is set up in person by an Encore team member at any Encore Car Wash location. Enrollment requires providing your vehicle's license plate information, your desired wash package, and a valid payment method to be securely kept on file.
4.4 License Plate Recognition and Stored Payment Information. By enrolling in The Fast Pass, you consent to Encore's use of license plate recognition technology to identify your vehicle and to Encore's storage of your selected wash package and payment method for the purpose of processing charges under this program. This information is handled in accordance with Encore's Privacy Policy.
4.5 Changes and Cancellation. You may update your wash selection, payment method, or cancel your Fast Pass enrollment at any time by speaking with a team member at any Encore Car Wash location or by contacting us at info@encorecarwash.com. Because no recurring fee is charged under this program, cancellation simply stops future automatic charges at your next visit.
4.6 Pricing. The 10% Fast Pass discount applies to the posted price of your selected wash package at the time of your visit. Encore reserves the right to modify Fast Pass pricing, the discount percentage, or program availability at any time, with notice as required by applicable law.
5. Auto-Renewal and Billing (Wash Club Memberships) – Your Wash Club Membership is a recurring subscription. By enrolling, you authorize Encore to automatically charge your payment method the applicable monthly Membership fee every 30 days, until you cancel in accordance with Section 6 or your Membership is otherwise terminated. This Section 5 applies to Wash Club Memberships described in Section 3; it does not apply to The Fast Pass, which is billed only on a per-visit basis as described in Section 4.
Your Membership will not be activated, and your payment method will not be charged, until you agree to these Terms.
Prepaid debit cards cannot be used to purchase or maintain a monthly Membership. A valid credit or debit card is required.
Membership fees are billed on a recurring 30-day cycle from your original enrollment date and will continue until cancellation.
6. Cancellation – You may cancel your Wash Club Membership at any time. Cancellation requires at least seven (7) days' notice prior to your next scheduled billing date in order to avoid being charged for the upcoming billing cycle. You may cancel using any of the following methods:

If cancellation notice is received fewer than seven (7) days before your next billing date, your card will be charged for that cycle, and your Membership will terminate at the end of that billing period.
For cancellation of The Fast Pass, see Section 4.5.
7. No Refunds All Membership fees are non-refundable – Encore does not provide refunds, credits, or prorated adjustments for any partial billing period, including for interruptions caused by weather, power outages, equipment maintenance, or other circumstances beyond Encore's reasonable control. Fast Pass charges, being per-visit, are likewise non-refundable once a wash has been provided.
8. Combination with Other Offers – Wash Club Membership pricing and the Fast Pass discount cannot be combined with each other or with any other offer, discount, coupon, or promotion unless expressly stated by Encore in writing.
9. Intellectual Property – All content associated with the Services — including the Encore name, logos, wash package and program names (such as The Encore, The Royale, The Lil' Darlin, The Dealeo, and The Fast Pass), graphics, and other materials — is the property of Encore or its licensors and is protected by applicable intellectual property laws. You may not copy, reproduce, distribute, or create derivative works from any such content without Encore's prior written consent.
10. Disclaimer of Warranties – THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. TO THE FULLEST EXTENT PERMITTED BY LAW, ENCORE DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. ENCORE DOES NOT GUARANTEE THAT ANY LOCATION, WASH FEATURE, OR SERVICE WILL BE AVAILABLE AT ALL TIMES OR FREE FROM INTERRUPTION.
11. Vehicle Condition; Damage Exclusions and Indemnification – Encore's wash equipment is designed to safely service standard, factory-configured vehicles in good operating condition. Encore is not responsible for, and expressly disclaims all liability for, loss of or damage to the following items, or arising from the following vehicle conditions:
Sunroofs
Spare wheel covers
Insignias and antennas
Pre-existing conditions
Damage caused by other customers' actions
Touch-up paint and prior repairs
Side mirrors and mirror covers
Windshield wiper arms and blades
Stem valves and wheel center caps
Vehicles ten (10) years or older, or with 100,000 or more miles
Windshield stress cracks, or pre-existing pebble chips or cracks
Molding and trim, including tow cover trim
Non-factory installed items, including light bars
Running boards not in the fully retracted position at the time of wash
Open pick-up truck beds containing objects or debris
It is your responsibility to ensure your vehicle is free of loose or non-factory items, that running boards are fully retracted, and that truck beds are clear of objects and debris before entering the wash. Encore reserves the right to refuse service to any vehicle that, in its sole discretion, poses a risk of damage to the vehicle or to Encore's equipment.
By using the Services, you acknowledge the conditions and limitations described in this Section, and you agree to indemnify and hold harmless Encore, its affiliates, and their respective officers, employees, and agents from any claim, loss, or damage arising from or related to any of the items or conditions listed above, or from your failure to prepare your vehicle as described in this Section.
12. Limitation of Liability; Arbitration Agreement and Class Action Waiver
12.1 Limitation of Liability. TO THE FULLEST EXTENT PERMITTED BY LAW, ENCORE, ITS AFFILIATES, AND THEIR RESPECTIVE OFFICERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICES. ENCORE'S TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF THESE TERMS OR THE SERVICES SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO ENCORE IN THE THREE (3) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED DOLLARS ($100).
12.2 Arbitration Agreement. Except for disputes that qualify for small claims court, you and Encore agree that any dispute, claim, or controversy arising out of or relating to these Terms or the Services (including the Wash Club and The Fast Pass) will be resolved by binding arbitration on an individual basis, rather than in court, administered under the rules of the American Arbitration Association then in effect. The Federal Arbitration Act governs the interpretation and enforcement of this arbitration provision.
If you do not want to be bound by this arbitration agreement, you must notify Encore in writing at 16340 S Lincoln Highway, Plainfield, IL 60586 within 30 days of first accepting these Terms, stating that you opt out of arbitration.
12.3 Class Action Waiver. You and Encore agree that any proceeding to resolve a dispute will be conducted only on an individual basis and not as a class, consolidated, or representative action. Neither you nor Encore may participate in a class action against the other.
13. Governing Law and Venue – These Terms are governed by the laws of Delaware, without regard to its conflict-of-law principles. To the extent any dispute is not subject to arbitration under Section 12, the parties consent to the exclusive jurisdiction and venue of the state and federal courts located in Will County, IL.
14. Modifications to These Terms – Encore may update these Terms from time to time. Updates will be posted on our website with a revised "Last Updated" date. Continued use of the Services after changes take effect constitutes your acceptance of the updated Terms.
15. Severability – If any provision of these Terms is found unenforceable by a court or arbitrator, that provision will be limited or modified to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
